Quantum Meruit – A Fair and Reasonable Claim?

Usually seen as an alternative claim to one in contract, quantum meruit claims frequently arise in building litigation. This cause of action has continued to develop over the years through the decisions of Horton v Jones, Pavey v Matthews and Sopov v Kane Constructions.

The Building Dispute Practitioners Society is extremely fortunate to have Mr Michael Wheelahan QC to attend to address the Society on the topic of quantum meruit.

Mr Wheelahan QC has experience in all types of civil litigation in the Supreme and Federal Courts, and in particular, in appellate work in the intermediate courts of appeal and in the High Court of Australia. He has appeared in many leading cases on appeal and at trial, including in the areas of negligence, class actions, insurance law, administrative law, constitutional law and commercial law, to name a few.
